Terms & Conditions of Sale

1. General
1.1 These Terms and Conditions govern all sales of goods by Select Drams (“the Seller”) to the customer (“the Buyer”). By placing an order, the Buyer agrees to be bound by these Terms.
1.2 No variation to these Terms shall be binding unless agreed in writing by the Seller.

2. Orders & Acceptance
2.1 All orders are subject to acceptance by the Seller. The Seller reserves the right to refuse or cancel any order at its discretion.
2.2 A contract is formed only upon written confirmation of an order by the Seller.

3. Pricing & Payment
3.1 Prices are as stated in the Seller’s price list, Website or quotation and are subject to change without notice.
3.2 Payment is due 30 days from invoice date unless otherwise agreed in writing.
3.3 The Seller reserves the right to charge interest on overdue payments at a rate of 2% per month.

4. Delivery & Risk
4.1 Delivery dates are estimates only and the Seller is not liable for delays beyond its control.
4.2 Risk in the goods passes to the Buyer upon delivery. Ownership remains with the Seller until full payment is received.

5. Returns & Cancellations
5.1 Returns are accepted only with prior written consent and must be in resaleable condition.
5.2 The Buyer must inspect goods upon delivery and notify the Seller of any defects or shortages within 48 hours.
5.3 Custom or special-order items are non-refundable.

6. Liability & Warranty
6.1 The Seller warrants that goods conform to their specifications but does not guarantee suitability for any particular purpose.
6.2 Liability is limited to the replacement of defective goods or a refund at the Seller’s discretion.
6.3 The Seller is not liable for any indirect or consequential loss.

7. Force Majeure
7.1 The Seller is not liable for failure to fulfil obligations due to events beyond its control, including but not limited to natural disasters, strikes, or supplier failures.

8. Governing Law
8.1 These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
